FAQ: Most Frequently Asked Questions
DOES THE FACT MY TEST RESULT WAS > .08 MEAN THAT I AM GUILTY?
Absolutely not! I have only handled 5 cases in my 25 years of practice where my client's BAC or BrAC was below the legal limit, and we are quite successful in getting the charge either dismissed or reduced when the test is over the legal limit. The test is only one part of the puzzle and does not override all the other evidence.
EVERYONE TELLS ME THAT I HAVE NO CHANCE TO WIN MY CASE. WHY SHOULDN'T I JUST PLEAD GUILTY?
First of all, the initial consultation with me is absolutely free. You will need to invest your time but no money to talk with me about your case. Sometimes there is no defense, but I often have found defenses where there just did not appear to be any hope. The highest BAC in a case that I won was a .34; however, her test result was not admissible so we won the case. When she first approached me it appeared to be an impossible case, but things fell in place for her defense.
HOW LONG DOES AN INITIAL INTERVIEW TAKE?
About 1 hour.
WHY SO LONG? ANOTHER ATTORNEY ONLY TALKED WITH ME ABOUT TEN MINUTES AND TOLD ME THERE WAS NOTHING HE COULD DO?
Unfortunately the amount of time spent on a case after being hired may be the same 10 minutes vs. an hour??? There is no way humanly possible for all the details regarding one's medical history, the circumstances surrounding the stop, the arrest and ultimate breath or blood testing can be discussed in ten minutes. The details are what win cases and if your attorney is not going to delve into the details there is no way one can rely on his or her advice.
WHERE DO YOU REGULARLY PRACTICE?
I practice all over the state and in the federal courts. If the jurisdiction is far away, I can refer you to someone to assist you that I have confidence in. I have handled cases in all parts of the state while maintaining an office in both northern Virginia and in Richmond.
WHAT ARE THE CONSEQUENCES OF A DUI CONVICTION?
They are many. The larger impact is to one's freedom, criminal record and cost of insurance. It can also cause immigration problems and restrict travel to foreign countries e.g. Canada. The conviction itself is put on one's criminal history and it remains there for your lifetime. These consequences are often much greater than what happens in the courtroom.
